The Louisiana Mineral Code governs the rights of mineral and royalty owners in Louisiana. The laws on mineral rights in Louisiana differ significantly from those in other states, such as Texas, where mineral rights can be sold outright. In Louisiana, it’s not legal to split ownership of surface and mineral rights through an outright sale. Instead, a special restricted type of mineral rights known as mineral servitude can be sold to allow a buyer to explore for and extract minerals.
There is one important restriction for Louisiana mineral owners to keep in mind regarding mineral servitude: prescription laws. Under prescription laws, mineral servitude rights are dependent upon the use of those rights. In other words, if the minerals are left unused for ten years, then those rights automatically revert to the land owner, with the intent being to encourage mineral development in the state.
